政策法规 (Policy Info): Autralia Mining Regulations

Mining in Australia includes coal, gold,bauxite, iron ore, nickel, copper andmany other base metals. Australia is alsoa significant producer of mineral sands.In addition, significant downstreamoperations such as smelting and refiningalso occur throughout the country.
The Australian mining industry has seenan unprecedented investment boomover the last five years. The reduction incommodity prices, and movementoffshore of exploration funds means thatthis level of investment will not besustained. Indeed, the dramaticreduction in exploration expenditure inAustralia raises some very significantquestions as to where the mines of thefuture in Australia will come from. Therecan be no doubt that Australia remainsone of the top destinations for miningcompanies, which is hardly surprising,given the excellent prospectivity. Thecountry, however, has a number of keyissues which need to be addressed toensure it can continue to grow its shareof the worlds mining industry.
Regulatory framework
Australia is divided into six states andtwo territories. The location of the minesite will determine the various state lawswhich must be complied with. Generally,a mining lease needs to be obtained,Australia is a well established mining country and it has been the back-bone to much of the development of the country over the last 200 years.Many overseas companies have direct investment into the Australianmining industry; whilst some level of approvals are required, they arerarely withheld.and will set out many requirementswhich need to be followed.
Since the early 1990.s there has beenmuch debate in Australia about theconcept of native title. The issue iswhether the Aboriginal people who inmany instances were on the land wellbefore the mining companies, are ableto retain an ownership interest in theland. Whilst some legislation has nowbeen passed on this matter, there is stillsignificant uncertainty and this has led toa significant amount of exploration beingheld up or deferred.
Foreign investment
Foreign investment in Australia iswelcomed. Whilst it is necessary forForeign Investment Review Boardapprovals in certain instances, these haveusually been granted.
Tax system
The Australian tax system is relativelyold fashioned and is currently beingreviewed. A goods and services tax isshortly to be introduced and an overhaulof all other taxation laws is beingundertaken. These are being greatlydebated at the moment, through theRalph review and the government.sresponse.
